Silkrent Terms of Service

1. Acceptance of Terms

By accessing or using the Silkrent platform (silkrent.com), you ("User," "you," or "your") agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use our services.

2. User Accounts and Registration

2.1. Account Creation: To access certain features of Silkrent, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Silkrent immediately of any unauthorized access or use of your account.

2.3. User Types:

• Car Renter Companies: Must provide valid company registration and financial information.
• Car Dealers (Individuals): Must provide accurate contact information and comply with listing requirements.
• Renters (Customers): Must provide accurate contact and payment information.

3. Platform Usage

3.1. Permitted Use: You agree to use Silkrent only for lawful purposes and in accordance with these Terms.

3.2. Prohibited Conduct:

• Use Silkrent for any illegal or unauthorized purpose.
• Impersonate any person or entity.
• Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Interfere with or disrupt the operation of Silkrent.
• Attempt to gain unauthorized access to any portion of Silkrent or any related systems or networks.
• Use any automated means to access or collect data from Silkrent.
• Post misleading or false information.

3.3. Car Listings:

• Car Renter Companies and Car Dealers are responsible for the accuracy of their car listings.
• Silkrent reserves the right to remove any listing that violates these Terms or is deemed inappropriate.

3.4. Rental Agreements:

• Silkrent facilitates the connection between Renters and Car Renter Companies or Car Dealers.
• The rental agreement is between the Renter and the Car Renter Company/Car Dealer, and Silkrent is not a party to that agreement.
• When renting from a Dealer, the rental agreement is solely between the renter and dealer. Silkrent takes no responsibility for that agreement.

4. Subscription and Payment

4.1. Subscription Plans (Car Renter Companies):

• Car Renter Companies must select a subscription plan (Standard, Premium, Partner).
• Subscription fees are payable as specified on the Silkrent platform.
• The Partner plan has a 10% commission fee from completed orders.
• Silkrent uses Bank of Georgia for payment processing.

4.2. Listing Fees (Car Dealers): Car Dealers must pay the applicable listing fees for each car listed. Payments are processed through Bank of Georgia.

4.3. Payment Processing: Payments are processed through Bank of Georgia (BOG). Silkrent does not store your credit card details.

4.4. Refunds: Refund policies are determined by the Car Renter Companies and Car Dealers, unless otherwise stated by Silkrent for its own subscription services.

5. Intellectual Property

5.1. Silkrent Content: All content on Silkrent, including text, graphics, logos, and software, is the property of Silkrent or its licensors and is protected by intellectual property laws.

5.2. User Content: By posting content on Silkrent, you grant Silkrent a non-exclusive, royalty-free, worldwide license to use, reproduce, and display such content.

6. Limitation of Liability

6.1. Disclaimer: Silkrent provides the platform "as is" and "as available" without any warranties.

6.2. Limitation: Silkrent shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of Silkrent.

6.3. Third-Party Liability: Silkrent is not responsible for the actions or omissions of Car Renter Companies, Car Dealers, or Renters.

7. Indemnification

You agree to indemnify and hold Silkrent harmless from any claims, damages, or expenses arising from your use of Silkrent or your violation of these Terms.

8. Dispute Resolution

8.2. Governing Law: These Terms shall be governed by and construed in accordance with the laws of Georgia.

9. Changes to Terms

Silkrent reserves the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on our platform. Your continued use of Silkrent after any changes constitutes your acceptance of the revised Terms.

10. Termination

Silkrent may terminate your access to the platform for any reason, including violation of these Terms.
